1) Introduction

These Terms & Conditions ("Terms") govern your access to and use of mobile applications, websites, and services provided by Calibrx AI ("Calibrx," "we," "us," or "our"), including but not limited to the Calipet app (collectively, the "Services"). By using the Services, you agree to these Terms. If you don't agree, do not use the Services.

2) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf.

3) Accounts

You're responsible for your account and credentials and for all activity under your account. You must provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms.

4) Acceptable Use

• No cheating or manipulation of game systems (e.g., submitting fake scans to earn rewards).
• No unlawful, infringing, or harmful activity.
• No reverse‑engineering, scraping, automated harvesting, or unauthorized copying/distribution.
• No uploading malware or harmful code.

5) Virtual Items & Purchases

The Services may offer virtual currency (e.g., "Diamonds") and virtual items (e.g., characters, cosmetics). These have no real‑world monetary value, are non‑transferable, and cannot be exchanged for money or goods outside the Services. We may modify or discontinue virtual items at any time. All purchases are final and non‑refundable unless required by law. Payments processed via Apple App Store or Google Play are governed by their terms; manage subscriptions and refunds through those platforms as applicable.

6) Health & Nutrition Disclaimer (Calipet)

Calipet may provide AI‑generated calorie and nutrition estimates. This information is for general informational purposes only and is not medical advice. Always consult a qualified health professional before making dietary changes or decisions.

7) User Content & License

If you upload or submit content (e.g., photos for recognition, profile details), you retain ownership of your content. You grant Calibrx a worldwide, non‑exclusive, royalty‑free license to host, store, process, reproduce, and display that content solely to operate, secure, and improve the Services. You represent that you have the rights to provide such content and that it does not infringe others' rights.

8) DMCA Notices

If you believe content in the Services infringes your copyright, send a notice with: (a) identification of the work and the allegedly infringing material (URL or location), (b) your contact info, (c) a statement of good‑faith belief, (d) a statement that the notice is accurate and you are the rights holder or authorized agent, and (e) your physical or electronic signature. Send to: legal@calibrxai.com. We may remove or disable access to the material and, where appropriate, terminate repeat infringers.

9) Intellectual Property

The Services, including software, designs, characters, graphics, and trademarks, are owned by Calibrx or its licensors and are protected by law. Except for your content and rights expressly granted, we reserve all rights.

10) Changes to the Services

We may update or discontinue features at any time. We're not liable for any modification, suspension, or discontinuation of the Services or any part thereof.

11) Warranty Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non‑infringement.

12) Limitation of Liability

To the maximum extent permitted by law, Calibrx will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, goodwill, or other intangible losses. In no event will our total liability for all claims relating to the Services exceed the greater of US$500 or the amount you paid us (if any) in the 12 months before the claim.

13) Indemnification

You agree to indemnify and hold Calibrx harmless from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

14) Governing Law & Venue

These Terms are governed by the laws of the State of California, excluding its conflicts rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California.

15) Changes to These Terms

We may update these Terms. If we make material changes, we'll take reasonable steps to notify you (e.g., update the "Effective Date," in‑app notice). Your continued use after changes means you accept the updated Terms.
